About using our services
Terms of service
Last updated
These terms apply to the websites, applications, hosted software, APIs, and other services provided by Moon Bunny Inc that link to or reference them. Moon Bunny Inc is registered in Washington State, United States. In these terms, “we,” “us,” and “our” mean Moon Bunny Inc.
Using our services
These terms apply to both free and paid services that reference them. By accepting these terms or using those services, you agree to follow them. If you do not agree, do not use the services. You must have the legal capacity and permissions needed to enter into this agreement.
You may access and use the services for their intended purposes, subject to these terms and any features or usage limits stated for your plan. This permission does not transfer ownership of our software or content.
Accounts and organizations
Where an account is required, keep your account information accurate and protect your credentials. You are responsible for the activity you authorize through your account. Tell us promptly if you suspect unauthorized access.
If you use a service on behalf of an organization, you must have authority to agree to these terms for it. Organization administrators may manage access and shared content within the permissions the service provides.
Payments and subscriptions
If you choose paid features, you agree to the fees and billing terms presented before purchase. The offer will explain the price, billing period, applicable taxes, usage charges, and any trial or renewal conditions.
Subscriptions renew automatically only when recurring charges have been clearly disclosed and you have authorized them. You can stop future renewals using the cancellation method provided with the service. Contact us if you need help canceling.
The purchase terms explain when cancellation takes effect, any refund or proration rules, and what happens to access. Your cancellation and refund rights under applicable law still apply. Canceling a subscription does not, by itself, request deletion of your account or content.
We will notify you before changes to recurring charges take effect and obtain any agreement required by law. Changes to a plan remain subject to the terms disclosed when you make that change.
Content and software
We or our licensors own the services, software, branding, and content we provide. This does not include content you or other users own. You may use our materials as part of the services; other uses require permission unless permitted by law or an applicable license.
Software and other materials released under an open-source or separate license remain governed by that license. These terms do not limit the rights those licenses grant.
Your content
You retain your rights in content you submit to the services. You must have the rights and permissions needed to provide it and to let us process it as described here.
You grant us a non-exclusive license to host, process, transmit, and display your content only as needed to provide, secure, and support the services according to your instructions and settings. Our service providers may carry out those tasks on our behalf. This license does not transfer ownership of your content to us.
Content you choose to publish or share may be accessed, copied, or retained by others. Use the service’s sharing options with care and keep a separate copy of important content. Retention and deletion are subject to our privacy policy and any applicable service or data processing agreement.
Acceptable use
Do not use the services to break the law, infringe another person’s rights, impersonate someone, distribute harmful or unsolicited content, or interfere with the services or their security. Do not access information without authorization or bypass access, usage, or payment restrictions.
Use APIs and other automated features within their documented permissions and limits. You are responsible for ensuring that your use of the services and the content you provide comply with applicable law.
Third-party services
Our services may link to or connect with services operated by others. When you choose to enable a connection, you authorize the access and transfers needed for that connection. Your use of the third-party service is subject to its own terms and policies.
We do not control third-party services or guarantee their continued availability. Our use of providers to deliver our own services remains subject to our privacy policy and any applicable agreement with you.
Privacy
Our privacy policy explains how we handle personal information and how you can contact us about it.
Service changes and availability
We may update the services and their features. If we discontinue a paid service or materially reduce its functionality, we will give reasonable advance notice where practicable and honor the remedies required by your agreement or applicable law. Urgent security or legal issues may require immediate changes.
Availability, support, backup, and export commitments apply where stated in the terms of your service or plan. Features described as beta or experimental may change and may be less reliable.
Suspension and ending access
You may stop using a service and request account closure through the service or by contacting us. Follow the cancellation process for any paid subscription so that future charges stop.
We may suspend or end access for a material breach of these terms, unpaid charges, misuse, or security or legal reasons. Where reasonable and lawful, we will explain the issue and give you an opportunity to resolve it. We may act immediately when delay would cause harm or violate the law.
When access ends, your permission to use the affected service ends. Any outstanding fees, applicable refund rights, and obligations that by their nature continue remain in effect. Data retention and deletion follow our privacy policy and any applicable agreement.
Warranties
Except for commitments we expressly make in your service terms or agreement, the services are provided “as is” and “as available.” We do not promise uninterrupted or error-free operation or that every service will meet every need.
To the extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. This does not reduce any warranty or other protection that the law requires.
Limits on liability
To the extent permitted by law, Moon Bunny Inc is not liable for indirect or consequential losses arising from your use of, or inability to use, the services. This includes lost profits, lost data, or business interruption.
Nothing in these terms excludes or limits liability, or takes away rights, where the law does not allow it.
Additional agreements
A service may have additional terms for a feature or plan. We will make them available before you use that feature or commit to that plan. A separately agreed contract or applicable additional terms control if they conflict with these terms, but only for the matters they address.
Contacting us about custom work does not, by itself, create a client engagement or commit either party to a project. Client work is governed by the agreement for that engagement.
Governing law
These terms are governed by Washington State law and applicable United States federal law, without regard to conflict-of-law rules. This does not override mandatory protections available to you under the law where you live.
If a provision cannot be enforced, the remaining terms continue to apply to the extent permitted by law. A decision not to enforce a provision does not waive the right to enforce it later.
Changes to these terms
We may revise these terms and will post the updated version here with its date. We will give notice of material changes before they apply where required by law or an agreement, and obtain renewed agreement where required. Changes do not remove rights you already have or retroactively change a separate agreement.
